If any of these people ever got on the soapbox against the practice of legislating from the bench or stumped for the need of judicial restraint, then they need to be returned to the private sector the next time they are up for re-election.
At this point I can only guess what would have been in the pipeline if this particular nomination was turned down.
Just wait until the eventual retirement of an associate justice happens, and his/her replacement will tip the balance of the court.
